Activision's Video Game Patent Lawsuit Escape Upheld on Appeal – Bloomberg Law

A Federal Circuit panel cemented Activision Blizzard Inc.’s win in a patent infringement lawsuit that alleged its video games violated a pair of patents meant to make game scenes look more realistic.

The Tuesday opinion allows the company behind Call of Duty to dodge Infernal Technology LLC’s claims that 19 of its games infringed US Patent Nos. 6,362,822 and 7,061,488, which enable real-time lighting and shadows in animations.

The Federal Circuit agreed with a district court that, under a mutually agreed-upon definition that underpins the patents, Activision’s products don’t infringe Infernal’s technology.
